A Fast, Fun, Friendly – and Essential – Guide to Legal Planning for Busy Parents

Legal planning for our kids is something for many of us that sits on our “to-do” lists for years and doesn’t make it any farther than that. It’s been that way for me, even after I benefitted from my parents’ planning and was spared many headaches when they died because of their forethought and the expertise of their attorney. That’s why I thought it was a great opportunity to review this book; it was timely as my husband and I reiterated our own legal planning needs, and I hoped to find the direction I lacked until now. As I began reading this book, I started asking my friends who was prepared, fully, for their children’s care, in the event of their death. Just one of my friends could say confidently that they had everything in order, nothing was remaining on her “to-do” list. Others are partway there, with life insurance and some ideas, but nothing formalized.
At the beginning of the book, in her personal message, Ms. Neely writes, “We spend an inordinate amount of time planning our children’s birthday parties and play dates. So why do we fail to plan for something guaranteed to happen: our lives and eventual deaths?” There was just no way to argue that. I have consciously been neglecting this incredibly important aspect of my children’s lives, and why? Because I was hung up about whom their guardians should be? As I read on, I realized there is so much more involved, so much more to consider and it was all really too important to put off.
Wear Clean Underwear is not a dry, how-to manual. There are three “case studies” that present different possibilities and outcomes which the reader navigates through like a “choose your own adventure” novel. I read all the scenarios, through which I learned about things that I would want to do, and what might happen if I didn’t make those arrangements. One of the hang ups many people had when I spoke with them was the uncertainty of who to leave the kids with? It never occurred to me to consider, and specify, who I wouldn’t want the kids with, but that was a lesson I learned from one of the possible scenarios the book.
As the final case study illustrates, trusts aren’t only for the rich. A family of modest means benefits from legal planning just as one with more assets does. The dollar value of the items we leave behind isn’t all that the trust protects. It guides our loved ones in making difficult decisions during a time of distress, letting them know exactly what we want and freeing them of that burden.
